Dowd Scheffel filed an amicus brief in The Boeing Company v. Secretary of the Air Force before the Federal Circuit. The amicus brief was filed on behalf of the U.S. Chamber of Commerce and Professional Services Council in support of Appellant Boeing. The brief outlines that the Armed Service Board of Contract Appeals erroneously interpreted the controlling statutes and its holding impairs the rights of contractors in technical data. Setting such a precedent will cause significant economic harm to private companies that contract with the federal government. The brief can be read here. The Federal Circuit’s decision can be read here.
