Dowd Scheffel Files Amicus Curiae Brief on Behalf of Senator Tillis, Judge Michel, and Andrei Iancu

April 9, 2021: Dowd Scheffel filed an Amicus Curiae brief on behalf of Senator Thom Tillis, the Honorable Judge Paul Michel (ret.), and former U.S. Patent and Trademark Office Director Andrei Iancu, in the closely watched case of Ericsson, Inc. v. Samsung Electronics, Co. before the U.S. Court of Appeals for the Federal Circuit. The brief argues that the Wuhan court’s unilateral interference is an improper intrusion on U.S. sovereignty and the right of U.S. courts to decide U.S. patent cases. It also discusses how judicial comity should be weighed as a factor in this case. The amicus brief was profiled in several reports, including articles by Bloomberg Law, IP Watchdog, IAM, and World Intellectual Property Review.
