Dowd Scheffel was delighted to work with Chief Judge Paul R. Michel (ret.) to assist with the filing of an amicus curiae brief supporting the crack down on repetitive and abusive patent challenges. The brief addresses several issues currently plaguing the Patent Trial and Appeal Board (PTAB) and discouraging confidence in the U.S. patent system. Under the current system, the PTAB is being used as a tool to delay patent enforcement and enableinfringement and innovation piracy, instead of serving its intended purpose as an alternative to district court litigation.
