March 16, 2021: Dowd Scheffel filed an amicus brief in Kannuu Pty. Ltd. v. Samsung Electronics Co. before the Federal Circuit. The amicus brief was filed on behalf of five leading intellectual property law professors. The brief emphasizes the importance of enforcing forum-selection clauses in private, duly negotiated agreements. Additionally, it highlights the district court’s misinterpretation of the precedent set forth by the Supreme Court in Lear v. Adkins in making its public policy argument.
